Tuffys Million Dollar Fundraiser - Terms and Conditions

1. Standard Terms

1.1 Batphone Australia P/L is the promoter of the Tuffys Million Dollar Fundraising Promotion

1.2 Batphone Australia P/L will donate one dollar (AU $1) inc gst per Tuffys Tub or Bucket sold, to a charity, school, sporting club or registered not for profit organisation nominated by the purchaser of the product, via the buyfundraisingtubs.com.au web shop.

2. Who Can Purchase?

2.1   Product may be purchased by any Australian resident, company or organisation and nominate the recipient of the donation.

3. Terms of Donation

3.1 Recipients of donations will be listed on the buyfundraisingtubs.com.au webpage with running tally of money donated.

3.2  Donations will be up to a collective total of one million dollars (AU $1,000,000) per calendar year for purchases made and paid for during that time period. Commencement date is August 10 2013. Should purchases not reach AU$1 million dollars in the period the amount donated will be equivalent to AU$1 per Tuffys Tub or Bucket purchased.

3.3   Payments will be made to recipients by cheque within 30 Days of EOM of purchase.

3.4   Nominated recipients must be a registered charity, school, P&C, Sporting Club or other not for profit organisation.

3.5 The promoter reserves the right to redirect the donation to a registered charity should the purchaser not nominate a known registered charity or it the recipient nominated is found to not qualify as a not for profit organisation or entity as described in section 3.4.

4. Order Process

4.1  All orders will be made via the buyfundrainingtubs.com.au web shop and paid for online unless prior arrangements have been made with Batphone Australia P/L

4.2 A minimum order of 4 units is required to process an order. (may be a combination of any colour or size)

4.3 Orders will be dispatched within 21 days of payments received & cleared.

4.4 Orders will be shipped, ex Brisbane warehouse, to a nominated destination within Australia for a handling, insurance & delivery fee of minimum AU$10 per order with freight calculated on recipients destination zone based on the zone areas of Couriers Please courrier network. Freight costs will be advised on web shop. Handling, insurance & delivery costs for areas outside nominated zones OR for orders that are over and above sizes that can be carried on regular couriers, the customer will be contacted with final costs for amount confirmation.

4.5 The Promoter will retain proof of dispatch of orders for tracking purposes.

5. NO LIABILITY

5.1   In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.

5.2   Batphone Australia PL will take no responsibility for the items purchased if damaged or lost in transit, or late, lost or misdirected mail.

5.3   Batphone Australia and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: 

5.3.1 arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion;

5.3.2 due to circumstances outside the Promoter’s reasonable control.

5.4   Batphone Australia and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of orders or nominations, and reserves the right to take any action that may be available.

5.5   If, for any reason, this promotion is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the process, take any action that may be available, and to cancel, terminate, modify or suspend the promotion, subject to State Legislation.
